A few press outlets have reported there is a "loophole" that can be exploited [1] [2]. These articles are based on the original analysis by AAISP [3].
The main suggestion is that users (in this case, providers of public wifi) be registered with the ISP as a "communications provider" rather than a subscriber. This would allow them to be exempt from certain sections of the act. At this time the only ISP to have implemented this as an option, that we are aware of, is AAISP.
