Technical Measures

Technical measures are defined in the Act as measures that—
- (a) limit the speed or other capacity of the service provided to a subscriber;
- (b) prevent a subscriber from using the service to gain access to particular material, or limits such use;
- (c) suspend the service provided to a subscriber; or
- (d) limit the service provided to a subscriber in another way.
Clearly option (d) leaves a good deal of scope for altering and extending the sanctions taken against subscribers who are found to be in contravention of the Act.
During the debate on the Bill it was expected that technical measures would include Disconnection and Traffic Shaping.
It is expected that the committee that decides how the Act is implemented will define what the technical measures are.
